If the shift does not exceed 6 hours, the employer and employee can voluntarily agree to waive that meal period altogether. That same non-exempt employee is entitled to a reasonable opportunity to take a 10-minute, on-the-clock, duty-free and uninterrupted rest period for every four hours (or major portion thereof) that they work.
